According to this Dakota County Criminal Complaint, a man with an IQ of approximately 70 who had the maturity level of what was suggested to be a 13 year old, was coerced by a group of females into financing a car and buying other assorted items for them with the direct suggestion that one would like to date him if he did.

The developmentally delayed male was identified as J.D.S. J.D.S. is under a guardianship in Olmstead County, Minnesota. D.S. is J.D.S.’s legal guardian. D.S. is assigned to assist J.D.S. with daily activities/decision making and management of finances. J.D.S. reportedly has an IQ of approximately 70. D.S. explained that talking to J.D.S. is like talking to a thirteen year old. According to D.S., J.D.S. also has a case manager.
A Rochester Police officer spoke with J.D.S. J.D.S. explained he met a girl named “Ashley” approximately a year ago, but hadn’t talked to her in about a year. He said he was out the other night and began talking to a female who he realized was “Ashley”. He said he met up with “Ashley” and “Tatriana”. He said another female, who “Ashley” referred to at different times as being her “mother” or “aunt,” later joined them. The female “Ashley” called her “aunt” or “mother,” went by the name “Na Nay” or “Ne Ne”.
Police learned that on July 19, 2011, a transaction had been completed by J.D.S. at a car dealership located in South St. Paul, Dakota County, Minnesota. The car was financed for $17,787 on J.D.S.’s line of credit. The salesman who completed the transaction, M.W., said there was a female with J.D.S. when J.D.S. completed the transaction. M.W. said the female had to direct J.D.S. where to sign and how to fill out the paperwork in order to complete the transaction.
J.D.S. told police he initially bought things for the women so “Ashley” would like him and date him. He said he later became suspicious, scared and believed the women might turn on him if he didn’t purchase things for them. He said he just wanted to go home. He said he stayed in a hotel room with the women during the weekend of the purchases. He said he was scared and at one point had separated his car keys from his house keys because he was worried they would take his keys, go to his house, and take things from his house. He said he started out buying things for Ashley so she would like him, but then as things were happening he became scared the women may call someone to come over and hurt him if they got angry with him.
While clearly this was a criminal case due to his mental capacity which the women undoubtably knew about and took advantage of, is this really any different than either of the sexes taking advantage of the other in relationships? If this individual had only an IQ of 70 and had a legal guardian to help with daily activities, including finances, why wasn’t this guardian put in full charge of his finances from the get go so that these sorts of decisions could not have taken place? I certainly refuse to blame the victim here, however those in the system should have done more to protect him and his finances.
What do you think about this one? How often do males and females in a relationship (sham or otherwise) take advantage of each other financially? Should the state and/or guardian have had more protections in place to keep this sort of thing from happening? Should more of the onus be placed on this guardians for not pushing for more control? How awful of a person do you have to be to knowingly take advantage of someone who is developmentally delayed like this? What would you think is a proper punishment for them?
