According to this Dakota County Criminal Complaint (and this one as well), a man was threatened with an “Uzi-like” gun in Lakeville after he suggested they “race” somewhere in the vicinity of CR-70 and I-35 (near Baldy’s BBQ and Goodfella’s Pizza).
From the complaints:
On April 23, 2011 at approximately 10:00 p.m., officers of the Lakeville Police Department were dispatched to a gas station in the 21000 block of Kenrick Ave in the City of Lakeville, Dakota County, Minnesota, on the report of a weapons complaint. Police spoke with the victim, M.D., who reported that he had been involved in a confrontation with an unknown male. Victim reported that following that confrontation, a male, later identified as Adam Joseph Pena, DOB: 8-1-91, took out a gun. The victim described it as an “Uzi type with a long clip.” The victim reported that he had challenged the occupants of another vehicle, which included Pena and another individual later identified as David Michael Johnson, DOB: 1-28-92, to a “race”. The victim reported that Johnson during a verbal exchanged formed the shape of a gun with his right hand and pointed the form gun shape at the victim and said something similar to “I’ll cap your f***ing ass.” The victim took this statement as a warning that Johnson would shoot him. The victim reported that a few moments later Pena, who was driving the vehicle, exited the driver’s position and walked to the trunk. The trunk was open and Pena proceeded to pull out a gun case. The victim indicated that Pena opened the case, pulled out the black Uzi-like gun, racked it and stood there. The victim reported that Pena held the gun in a downward position and did not point it directly at victim. Pena placed the gun into a gun case and put it back into the trunk. Pena then told the victim that their group would be back in twenty minutes.
While we already know about all the bad MFers in Apple Valley, Eagan and those who are willing flash a gun while in traffic, but are you surprised that someone would be willing to pull out what was described as an Uzi-like weapon in rural Lakeville? Do you think that the person had it coming to them when they challenged others to a race? Are you at all concerned that the victim wasn’t charged for suggesting that they street race? Are you disappointed that Lakeville’s police department aren’t doing more to stop street racing such as the races that occur fairly frequently between traffic lights near Flagstaff and 160th? Whatever you have to say about an Uzi being pulled on someone in Lakeville go ahead and comment on as I’d love to hear your thoughts.

I really dont care about the racing, although I would prefer it be kept to later in the evening and lower traffic areas.
I do care a great deal about people having machine guns in thier trunk and feeling its ok to take it out in public and threaten someone with it.

nobody ‘has it coming’ to them for any reason, unless your name is—never mind.
i don’t think they could charge anyone for drag racing unless they were caught in the act. maybe they need to stake out 160th to catch some of the drag racers.
did officer friendly get the ‘gun’ or just the case? maybe AJP ditched it before returning to the scene of the crime?
what’s the staffing of lakeville’s finest? just curious.

“Rural Lakeville.” Some might call that redundant! But no, I’m not surprised – I rarely am – where this type of weapon, or for that matter, any type of weapon, is displayed in Lakeville. Nor do I believe anyone deserves to be threatened in this manner unless they themselves pose an immediate threat to others. If the police didn’t witness the street race, I’m not sure what options they have for prosecuting either party. Let’s see …. these guys were racing near 210th and Kenrick, so extra patrol around 160th and Flagstaff wouldn’t have done much good, at least not in this case. How many accidents are caused by street racing vs. distracted driving, of any kind, but mostly by teens and young adults? Both types of offenders are tough to catch, but that’s where police should focus most of their attention. A gun in the hands of a local troublemaker is one thing. The police often know, or know of, these individuals, enabling them to respond accordingly to weapons-related problems. This also helps increase the possibility of a successful resolution to the incident. But the people who pose the biggest threat to Lakeville – the “bad guys” intent on using a gun in a crime – are the ones police don’t know about.

The complaints don’t mention if the police searched his vehicle or anything like that. Was that just not included in the document, or did they not search the car? It seems like something they should have done, though I’m not really familiar with the process in these situations.

I blame it on the moving around of the train cars. If they had just left them be, the ne’er do wells would have just stayed in there doing their drugs and whoknowswhatelse instead of taking their violence and crime to the streets.

Surprised that someone has an Uzi in their trunk in Lakeville? No. Surprised that the person in question was a youth? yes. Surprised that a 19 year old male who thinks their car is fast, and has an Uzi in the trunk, would brandish the weapon at another person? Hell no, I’m not surprised.
I’m not sure what you can get charged with for suggesting to someone that you race. I think you actually have to do it. I think that if police catch someone racing another car, they should ticket them. Thus why I make a point of avoiding police cruisers when I’m testing my car as well as try to go somewhere people are not. I don’t race on the street, but I do have to test prior to going racing from time to time and there isn’t a decent local chassis dyno.

Tim, yeah, I thought the complaint was pretty thin on details in that way. I mean they had probable cause and they saw it in plain view. Why didn’t they bother to open the case or at least say in the complaint that they did?
Maybe one of the attorney types can shed some light on that.

No need. It was all under control. Wait for a warrant and there can be no question of illegal search. At this point, whether there was really a gun, or something that only looked like a gun (paintball gun, airsoft gun, cap gun, wood carving, etc.) seems to be irrelevant. They are being charged with making a terroristic threat. It is only important that they indicated they have a gun. There may be other charges added later if they were in illegal possession of a firearm or something. Even if it was a real gun, if they were legally in possession and transporting it in the trunk, and the weapon itself is not illegal for some reason (fires fully automatic, etc.), this charge may be the best they can hope for. The gun was not actually pointed at anyone, so any assault claims would be pretty weak.

Saying, “I am going to put a cap in your ass.” easily constitutes a terroristic threat if they wanted to go down that road. Having been victim of that particular crime twice in my life, the threats against me were a hell of a lot weaker than that one.
